LiveWire is more than a motorcycle. At LiveWire we redefine electric, delivering the best experience for the urban rider, with personality and soul. This Privacy Notice will provide you with information regarding how LiveWire collects, uses, and shares information about you, including the choices we offer with respect to that information. This Privacy Notice applies to any LiveWire website or service that posts a link to it (collectively, the “Services”). Additional privacy notices may apply to other LiveWire Services. With the exception of LiveWire Labs, LLC, which are LiveWire’s company-owned dealerships (hereinafter the “Company-Owned Dealership(s)”), LiveWire dealers (“Dealers”) operate independently from LiveWire. This Privacy Policy does not apply to them or your communications with them. Personal Information We Collect

Personal Information You Provide

We may collect personal information from you when you visit our website, save your information with us online, contact us with a question or concern, want to organize a test ride or rental, process your information for warranty purposes, or participate in a contest, promotion, or survey. We will also collect personal information from you if you purchase a LiveWire motorcycle online.

The information you provide may include:

  • Your name, email address, postal address, phone number, gender, birthday, and other registration information.
  • Information about your product and service interests.
  • Transaction-related information, including information about the purchases you make and services you subscribe to online, by phone, or in our Company-Owned Dealership(s), the LiveWire Experience Center(s), and Dealers.

We may collect personal information from you when you visit one of our websites or stores, use our mobile app, place an order with us online or by phone, make an in-store purchase, save your information with us online, contact us with a question or concern, or participate in a contest, promotion, or survey.

If you subscribe to LiveWire™ Connect and Vehicle Integration Services, we will collect and process certain personal information about you and your vehicle for the purposes of providing the LiveWire Connect and Vehicle Integration Services, (together, the "LiveWire Connect and Vehicle Integration Data"). LiveWire Connect and Vehicle Integration Data may include identifiable information, such as name, Customer Profile ID, and contact information, credit or financial account number or other payment details.

Providing the information identified in this section is optional. However, if we do not collect this information, we may not be able to provide you with the products and Services you have requested. We maintain a record of your product and service interests, the purchases you make, and services you subscribe to online, by phone, or in our stores. Information collected may be combined with information we acquire from our marketing partners or other unrelated third parties as permitted by local law.

Information from Dealers and Vendors

We may receive certain information from marketing partners or other third parties, as permitted by local law. Additionally, Dealers may share certain information with us in connection with your purchase of a LiveWire vehicle.

Information We Collect Automatically

LiveWire, its vendors, and/or Third-Party Services (defined below) may also automatically collect certain information about you when you access or use the Services. Additionally, if you subscribe to LiveWire Connect and Vehicle Integration Services and authorize us to collect data from your LiveWire vehicle, we will collect certain information automatically from your vehicle. Collectively, we refer to this information as “Usage Information”. Except to the extent required by applicable law, LiveWire does not consider Usage Information to be Personal Data. The methods that may be used on the Services to collect Usage Information include:

  • Log Information. Log information is data about your use of the Website, such as IP address, browser type, Internet service provider, referring/exit pages, operating system, date/time stamps, and related data, and may be stored in log files.
  • Information Collected by Cookies, SDKs, and Other Tracking Technologies. Cookies, web beacons (also known as “tracking pixels”), embedded scripts, location-identifying technologies, fingerprinting, device recognition technologies, in-app tracking methods, and other tracking technologies now and hereafter developed (“Tracking Technologies”) may be used to collect information about interactions with the Service or our emails.
  • LiveWire Connect and Vehicle Integration Data. When you subscribe to and use LiveWire Connect and Vehicle Integration Services, we collect certain information about you and your vehicle to provide the LiveWire Connect and Vehicle Integration Services. Such information includes information regarding software updates sent to your vehicle and the installation status of such updates, vehicle health data, such as odometer reading, fuel range, battery status, tire pressure, ride mode, charging status, and maintenance schedule. We also collect precise geolocation data to enable us to provide the LiveWire Connect, Vehicle Integration, and Stolen Vehicle Services. To enable the LiveWire Connect and Vehicle Integration Services, we also collect certain mobile application data, such as your device type, operating system, IP address, unique identification number, browser type, Internet service provider, app usage information, and mobile phone number.

Some information about your use of the Services and certain Third-Party Services may be collected using tracking technologies across time and services and used by LiveWire and third parties for purposes such as to associate different devices you use and deliver relevant ads and/or other content to you on the Services and certain Third-Party Services.

How We Use Personal Information

We may use your personal information:

  • To enable LiveWire to provide you with the highest quality experiences, products, services, applications, and motorcycles.
  • To personalize and enhance your experiences when you interact with LiveWire.
  • To process and fulfill your orders, which includes sending you emails to confirm your order status and shipment of your order.
  • To communicate with you and send you information by email, postal mail, telephone, text message, or other means about our products or services you have requested.
  • To administer contests and promotions, and to respond to your requests.
  • To help us learn more about your motorcycle and retail preferences.
  • To help us manage and improve our websites, events, experiences, products, and services.
  • To update you on membership programs, benefits, and services, and to enhance your membership experience.
  • To authenticate you.
  • To perform market and demographic research.
  • To establish or exercise our legal rights or defend against any legal claims, or when necessary, to investigate, prevent, or respond to suspected illegal activities or fraud, or to protect the safety, rights, or property of you, us, or a third party.
  • To enhance your ownership experience.

You can unsubscribe at any time from receiving promotional communications by following the instructions in such messages. Even if you have opted out of receiving promotional communications from us, please be aware that we may still contact you for other purposes. For example, we may contact you to provide communications you have consented to receive, regarding the products or services we provide to you, or if you contact us with an inquiry.

Retention of Personal Information

The amount of time LiveWire will retain personal information varies, depending on the services LiveWire has provided and the nature of the personal information that LiveWire holds. LiveWire retains personal information as necessary so that LiveWire may respond to issues or questions that arise or to comply with certain legal requirements.

When personal information is no longer required by LiveWire or by law, LiveWire will either convert it into an aggregated non-identifiable form or LiveWire will appropriately destroy or erase the personal information in a manner that is in accordance with LiveWire’s current policies and procedures.

Third-Party Content, Services, Analytics, and Social Features

The Website may include hyperlinks to websites, platforms, applications, or services operated by third parties (“Third-Party Service(s)”). These Third-Party Services may use their own cookies, web beacons, and other tracking technologies to independently collect information about you and may solicit Personal Information from you.

Certain functionalities on the Website permit interactions that you initiate between the Website and certain Third-Party Services, such as third-party social networks (“Social Features”). Examples of Social Features include: “liking” or “sharing” LiveWire’s content or logging in to the Service using a Third-Party account (e.g., using Facebook to sign-in to the Services). If you post information on a Third-Party Service that references LiveWire (e.g., by using a hashtag associated with LiveWire in a tweet or status update), your post may be used on or in connection with the Services or otherwise by LiveWire. Also, both LiveWire and the third-party may have access to certain information about you and your use of the Service and other Third-Party Services.

LiveWire may engage and work with vendors to serve advertisements on Third-Party Services. Some of these ads may be tailored to your interests based on your browsing of the Service and elsewhere on the Internet, which may include use of precise location and/or cross-device data, sometimes referred to as “interest-based advertising” and “online behavioral advertising” (“Interest-Based Advertising”), which may include sending you an ad on a Third-Party Service after you have left the Service (i.e., “retargeting”).

LiveWire may use Google Analytics or other vendors for analytics services. These analytics services may use cookies and other tracking technologies to help LiveWire analyze how individuals use the Services. Information generated by these services (e.g., your IP address and other Usage Information) may be transmitted to and stored by these vendors on servers in the U.S. (or elsewhere) and these vendors may use this information for purposes such as evaluating your use of the Service, compiling statistic reports on the Service’s activity, and providing other services relating to Service activity and other Internet usage.

Information collected, stored, and disclosed by third parties remains subject to their privacy policies and practices, including whether they continue to share information with LiveWire, the types of information shared, and your choices on what is visible to others on Third-Party Services. LiveWire is not responsible for, and makes no representations regarding, the policies or business practices of any third parties, including, without limitation, analytics vendors and Third-Party Services associated with the Service. We encourage you to familiarize yourself with and consult their privacy policies and terms of use.

Personal Information Disclosures

We may disclose your personal information for certain business purposes as described below:

  • Our Corporate Family: We may disclose your personal information within the Harley-Davidson family of companies throughout the world  (including with, but not exclusive of, Harley-Davidson Inc., HD U.S.A. LLC, Harley-Davidson Motor Company Group LLC, Harley-Davidson Motor Company Inc., Harley-Davidson Motor Company Operations Inc., and Harley-Davidson Dealer Systems Inc.) to assist us in providing LiveWire Services to you, offer personalized experiences, offer products or other services that may be of interest to you, and to process online orders and other requests.
  • Dealers and HDFS: We may also disclose information to LiveWire Dealers and Harley-Davidson Financial Services (HDFS) to facilitate transactions with you. Please note that if you are a subscriber of LiveWire Connect and Vehicle Integration Services and you have a vehicle loan in place with HDFS, in accordance with your agreement with HDFS, we may disclose the location data of your vehicle with HDFS if you default on your vehicle loan.
  • Vendors: We may also disclose personal information to our vendors to the extent necessary for those vendors to provide services to us, including, but not limited to, technology partners, payment providers, marketing partners, professional advisers, and suppliers. In addition, we may give anonymized data (data that cannot be traced back to you) to vendors for statistical purposes and for analyzing and improving our Services. We take steps to ensure that these companies are contractually obligated to keep the personal information that we provide to them confidential and to use such information only as we permit. We may also disclose personal information to non-affiliated companies that market LiveWire branded products and services, or in connection with your financial obligations concerning a LiveWire product or service. These companies have their own privacy practices and notices.
  • Certain Business Transfers: Your personal information may be disclosed as part of a corporate business transaction, such as a merger, acquisition, or joint venture, or for the financing or sale of LiveWire assets and could be transferred to another party as one of the business assets in such a transaction. It may also be disclosed in the event of insolvency, bankruptcy, or receivership.

We may disclose your information as required or permitted by law, including sharing with governmental agencies, law enforcement, or authorized third parties, in response to a verified request relating to a criminal investigation or alleged illegal activity or any other activity that may expose us, you, or any other party to legal liability.

Your Personal Information Choices

Accessing or Changing Your Personal Information

You can access and correct certain personal information by logging into your LiveWire Account from our website or mobile application. To access or correct your personal information at a LiveWire website or application, simply sign into your account using your email address and password, and you will be able to edit certain personal information in your LiveWire Profile.

You can also ask us for access to your personal information, to have it corrected or updated or, to the extent allowed by applicable law, limit the uses of your personal information by contacting us via one of the methods described in the section entitled "How do I contact LiveWire?"

Your Communication Choices

LiveWire wants to communicate with you only if you want to hear from us. If you change your mind about your current communication preferences with LiveWire, you can use the unsubscribe feature in a marketing email or log into your LiveWire Profile via our website or mobile app to change your preferences. You can also contact our customer service team via phone or mail as described in the section entitled "How do I contact LiveWire?"

We are required by law to provide motorcycle owners with warranty and recall information. Please note that when you make a business transaction with us (for example, purchase a product or subscribe to a service) we will confirm your order or subscription status (and any related shipment) by email. We may also need to contact you via telephone, email (in accordance with applicable laws), postal mail, or notification via the mobile app with questions or information regarding your order or subscription.

Promotional opt outs are entity specific. Opting out with respect to one entity is not automatically effective with respect to the others. For example, opting out of promotional emails from LiveWire does not opt you out of promotional emails from Harley-Davidson Motor Company.

LiveWire dealers are independent entities. Dealers may share certain information with us in connection with your purchase of a LiveWire vehicle. However, this notice does not apply to independent LiveWire Dealers or your communications with them. To change your privacy preferences with a LiveWire Dealer, please contact the dealer directly.

Data Security

LiveWire takes the security of customer personal information seriously and has implemented reasonable security measures to protect personal information. Although we do our best to protect your personal information, the transmission of information via the Internet is not completely secure, so you should also take reasonable precautions to protect your own personal information when using the Internet.

Information for Residents of Certain Jurisdictions

International

To support LiveWire’s operations, the majority of our computer systems, networks, and devices are currently based in the United States. Accordingly, personal information we obtain through our Services may be processed in the United States and elsewhere where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. By accessing our Services, you consent to the collection and processing of your personal information in the United States.
